Terms of Service

FirstPass is operated by Home Caption Marketing LLC ("FirstPass", "we", "us"). By creating an account or using the service, you agree to these terms. If you don't agree, don't use the service.

FirstPass offers a paid subscription at $5.99 per month, which includes 5 coverage reports per calendar month. New accounts also receive 1 free coverage report at signup with no card required. Unused reports do not roll over to the next month.

You may cancel your subscription at any time from your Account page. Cancellation takes effect at the end of your current billing period — you keep access and your remaining report quota until that date. No phone calls, no retention forms, no penalties.

Payments, billing, tax, cancellations, and refunds are handled by our reseller and Merchant of Record, Paddle.com, under the Paddle Buyer Terms. Our order process is conducted by Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns.

We process personal data as described in our Privacy Notice. We do not sell your data and do not train AI models on your submissions.

You retain 100% of the rights to any material you submit. We do not claim, license, sublicense, or train AI models on your submissions. Your text is processed solely to generate your coverage report and is stored only in your private account history for your own reference. You may delete any report from your account at any time.

You agree to submit only material you have the legal right to submit, and that you are of legal age (or have authority to bind the organization you represent). You may not use FirstPass to:

• Process content that is unlawful, infringing, or that you do not own or have permission to analyze
• Generate content that is illegal, hateful, sexually explicit involving minors, defamatory, or designed to harass or harm
• Attempt to jailbreak, bypass safety filters, or extract the underlying model
• Generate malware, phishing content, or instructions for violence
• Misrepresent AI-generated coverage as human editorial work for the purpose of defrauding others
• Scrape, probe, reverse-engineer, or otherwise interfere with the service or its security
• Resell or redistribute access to the service
• Bypass usage limits or share an account

We may remove content, restrict outputs, or suspend accounts that violate these rules. Repeated rights-holder complaints about a user's submissions may result in account termination.

Coverage reports are produced by an AI model. You are responsible for your prompts and submissions, for verifying the accuracy of any output, and for how you use the output. Reports are intended as a structured pre-read, not a substitute for human editorial judgment, legal advice, or guaranteed industry outcomes. Outputs may contain inaccuracies and should not be relied on without your own review. We make no warranty that following a report's suggestions will result in representation, sale, or production of your work.

The FirstPass service, software, branding, and documentation are owned by Home Caption Marketing LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service within your subscription plan. You may not reverse engineer, resell, or circumvent technical limits of the service.

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free service. Scheduled maintenance or temporary outages do not entitle you to a refund. If a report fails to generate due to a service error, it does not count against your monthly quota.

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

You agree to indemnify and hold harmless Home Caption Marketing LLC from any claims arising out of content you submit, your unlawful use of the service, or your violation of these terms.

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. You may delete your account at any time. On termination, your stored reports are deleted within 30 days, except where we are required to retain limited records for legal or tax purposes.

We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance.

These terms are governed by the laws of the State of formation of Home Caption Marketing LLC, without regard to its conflict-of-laws rules. Disputes will be brought in the courts of that jurisdiction.

You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure to perform due to events beyond reasonable control (natural disasters, war, internet outages, etc.).
